I am not a leading authority on any one discipline that I write about and teach, it is my hope and wish that with all the subjects I have studied it provides me an advantage point that I offer in as clear and cohesive writings as possible in introducing the matters in my materials. I hope to serve as one who inspires direction in the practitioner so they can go on to discover greater teachers and professionals that will build on this fundamental foundation. Find the authorities and synthesize a wholehearted and holistic concept, perception and belief that will not drive your practices but rather inspire them to evolve, grow and prosper. OPINION: Criminal Justice

Blog Article/Post Caveat (Read First Please: Click the Link)


It is a simple definition, "the system of law enforcement that is directly involved in apprehending, prosecuting, defending, sentencing, and punishing those who are suspected or convicted of criminal offenses." It is a very complex system that is currently strife with inconsistencies, imbalances and just plain political shenanigans that focus on winning over losing rather than true justice for all. 


For instance, in the arena of self-defense the laws shift the balance to those with little or no experience in criminal behaviors and law because those in that state tend to lack the understanding and knowledge necessary to combat the system making them 'easy prey' for the legal system, i.e., prosecutors, defense lawyers and the many others that make up said criminal justice system. 


Each state has their own rendition but all tend to fall under the generalizations I presented above. For instance, in California, "California's criminal justice system can be thought of as having four stages: (1) the commission of the crime, (2) arrest by law enforcement, (3) prosecution of a case in the trial courts, and (4) detention and supervision by corrections agencies."


Even if you truly defended yourself, one must adhere to very strict mandates, requirements and restrictions that create situations that even the smallest, slightest or seemingly insignificant mistakes can take you into the world of the criminal and the injustices of the system the jeopardize one's freedoms and livelihood. Even the systems for policing are reaching a level of scrutiny and requirements, etc., that make any infraction no matter how small or how insignificant in the totality of events, information, facts or evidence, etc., resulting in criminal attack and perceived justified conviction regardless of intent and one's efforts to act with the best of intentions in both legal and socially acceptable efforts. 


One who trains to provide themselves self-protection if subjected to criminal activities that span that time necessary to gain response from authorized authorities often means one not only has to protect themselves from criminals and criminal activities but they must protect themselves from the very system that must protect them, the criminal/legal systems who due to their win-loss mind-state often fail to protect the innocent and prosecute the guilty regardless of intent. 


No one goes into a self-protection event with the mind-set to break the laws in criminal ways but if one has failed to achieve a true understanding and skill set to protect and defend against criminals and the criminal legal systems then they can easily, at the very whim of those in judgement and those who make such decisions dependent on the ability to win over losing, find themselves locked up with some very dangerous folks with feelings of, "how did this happen, I was only protecting myself!"


Justice is truly blind except to those who run the system and how the perceive their ability to win over losing and how that effects their status and earning abilities. So, with that in mind, take heed and do your best to first and foremost understand all the systems involved then do your very best to avoid them. If you can't or don't, pray you have the skills to remain in the "Self-defense square!" It is a very complex system and even those professionals within it can't, don't and often mistake the process not in one's favor.
