Hey, Attention on Deck!

Hey, NOTHING here is PERSONAL, get over it - Teach Me and I will Learn!

When you begin to feel like you are a tough guy, a warrior, a master of the martial arts or that you have lived a tough life, just take a moment and get some perspective with the following:

I've stopped knives that were coming to disembowel me

I've clawed for my gun while bullets ripped past me

I've dodged as someone tried to put an ax in my skull

I've fought screaming steel and left rubber on the road to avoid death

I've clawed broken glass out of my body after their opening attack failed

I've spit blood and body parts and broke strangle holds before gouging eyes

I've charged into fires, fought through blizzards and run from tornados

I've survived being hunted by gangs, killers and contract killers

The streets were my home, I hunted in the night and was hunted in turn

Please don't brag to me that you're a survivor because someone hit you. And don't tell me how 'tough' you are because of your training. As much as I've been through I know people who have survived much, much worse. - Marc MacYoung

WARNING, CAVEAT AND NOTE

The content surrounding the extracts of books, see bibliography on this blog site, are also mine and mine alone therefore errors and omissions are also mine and mine alone and therefore why I highly recommended one read, study, research and fact find the material for clarity. My effort here is self-clarity toward a fuller understanding of the subject matter. See the bibliography for information on the books. Please make note that this article/post is my personal analysis of the subject and the information used was chosen or picked by me. It is not an analysis piece because it lacks complete and comprehensive research, it was not adequately and completely investigated and it is not balanced, i.e., it is my personal view without the views of others including subject experts, etc. Look at this as “Infotainment rather then expert research.” This is an opinion/editorial article/post meant to persuade the reader to think, decide and accept or reject my premise. It is an attempt to cause change or reinforce attitudes, beliefs and values as they apply to martial arts and/or self-defense. It is merely a commentary on the subject in the particular article presented.

“What you are reading right now is a blog. It’s written and posted by me, because I want to. I get no financial remuneration for writing it. I don’t have to meet anyone’s criteria in order to post it. Not only I don’t have an employer or publisher, but I’m not even constrained by having to please an audience. If people won’t like it, they won’t read it, but I won’t lose anything by it. Provided I don’t break any laws (libel, incitement to violence, etc.), I can post whatever I want. This means that I can write openly and honestly, however controversial my opinions may be. It also means that I could write total bullshit; there is no quality control. I could be biased. I could be insane. I could be trolling. … not all sources are equivalent, and all sources have their pros and cons. These needs to be taken into account when evaluating information, and all information should be evaluated. - God’s Bastard, Sourcing Sources (this applies to this and other blogs by me as well; if you follow the idea's, advice or information you are on your own, don't come crying to me, it is all on you do do the work to make sure it works for you!)

“You should prepare yourself to dedicate at least five or six years to your training and practice to understand the philosophy and physiokinetics of martial arts and karate so that you can understand the true spirit of everything and dedicate your mind, body and spirit to the discipline of the art.” - cejames (note: you are on your own, make sure you get expert hands-on guidance in all things martial and self-defense)

“All I say is by way of discourse, and nothing by way of advice. I should not speak so boldly if it were my due to be believed.” - Montaigne

I am not a leading authority on any one discipline that I write about and teach, it is my hope and wish that with all the subjects I have studied it provides me an advantage point that I offer in as clear and cohesive writings as possible in introducing the matters in my materials. I hope to serve as one who inspires direction in the practitioner so they can go on to discover greater teachers and professionals that will build on this fundamental foundation. Find the authorities and synthesize a wholehearted and holistic concept, perception and belief that will not drive your practices but rather inspire them to evolve, grow and prosper. My efforts are born of those who are more experienced and knowledgable than I. I hope you find that path! See the bibliography I provide for an initial list of experts, professionals and masters of the subjects.

The Legal System

Blog Article/Post Caveat (Read First Please: Click the Link)

Let's say, a family member is in need of open heart surgery. Do you get out your tool chest, put them on the coffee table and begin? Do you take them to your general practitioner and expect that doctor to perform an outpatient open heart surgery? Who do you call? It ain't ghost busters I can tell you that. The legal system is something similar because you’re well being, your economic status and your very life is also, like open heart surgery, is on the line.

The legal system, like the cardio system, is a very complex one that for a novice lays out a minefield of dangers that one not of the system cannot traverse on their own and even when seeking out assistance, who you choose can be just as dangerous and harmful, more so in some cases, gravely so including the option of death.

If one of us, of the martial self-protection or even just an every day soul forced to defend and protect against violences, is thrust into the legal system under self-defense as a defense the minefield is being laid out at the moment the first responders arrive to begin interviews, investigations and interrogations where the negotiations between those first responders and you are heavily stacked against you regardless of the self-defense lessons you have received.

Picture yourself visiting the zoo where you are standing outside of a cage with a very large and dangerous tiger or lion or other predator. The only shield you have against that predator is the cage they are in. You have read about them, you have watched programs and productions on the nature and life of those predators and you have learned a few things from other sources all claiming expertise. Do you assume your skills are such that you can walk up to that cage door, open the lock and step inside and literally face that big cat be it lion, tiger or other large predator and hope to survive?

Listen, the legal system is a very complex machine with an input flu and an output flu with a vary large complex internal system that is closed to all those who have not taken up the sword that is the legal system as a profession. Even those who do take up that legal sword are aware that dependent on the very legal attack that their part of the system may not be adequate to defend and protect ergo they, if you are lucky, will recommend a professionally skilled legal person to take up your case - if you are lucky.

No lessons, classes or other media claiming it has information of the legal system will get you through the mean machine that will chew you up and spit you out into the penal system faster than McDonald's can serve up your big breakfast. Even when you find a professional legal representative specializing you self-defense defense guarantee's the machine won't spit you out the other end in shambles, in jail and ruined for life. Note, 'for life' means - for your entire life until death do you part.

The legal system is not about you, it is about the members of that system as to their status, their ability to dominate in the court and their manipulative ability to influence and cause others, think jurors, etc., to comply with their perceptions and beliefs and views of the laws involved so that - THEY WILL WIN.

When you enter the legal system it is all about the people in that system likened to a football team where their is the defense team facing off against the prosecutor's team and you are the football that is put into play. You hope your team, the defensive, wins but remember that the law, jurors and the judge are the arbitrators or referee's who decide in the end.

The last thing you want to assume is that your Google-knowledge based understanding of the legal system just isn't going to do it for you. You should already know that such things are questionable even for representation who has completed a law degree, who has gained actual hands-on experience trying cases in the system and who understands such minute aspects of the law and legal system under the heading of "self-defense law" may not actually understand what it will take of and from you, and who actually even cares, your role in the defense of self-defense of the before, what you did during and the after that fills up your life the moment you apply your skills in self-protection.

So, go ahead, get your brother-in-law to break out the old tool chest, jump up on that dining room table and tell him to get 'cracking open your chest' to repair your heart because hiring a cardiovascular surgeon who specialized in bypass surgery is just too damn expensive and hey, your bro-in-law just rebuilt that chevy 327 for you and did a bang up job, right?

Very, very, very few from any source including in the lessons on the dojo floor over the last four decades of my personal experiences has even broached the subject of the law, the legal system and how to navigate and survive that minefield has ever spoken up and to such subjects so, even you your are successful with your skills to protect and defend against violence is your sensei going to come to your aid in the court of law for you?

The legal system is tantamount to space travel in your car if you don't have the baking and support of a member of the space system, NASA, so why would you ask your bro-n-law, or your sensei, to perform surgery on you in the medical system?

Something to think about...
